1. Acceptance of Terms

By accessing or using MasterClasswithMelody.com (“the Site”) and any services offered by MasterClass with Melody (“we,” “our,” or “us”), including online courses, coaching sessions, membership programs, and related content (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use our Services.

2. Eligibility

You must be at least 18 years of age to use our Services. By using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Account Registration

To access certain features of our Services, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Services Offered

4.1 Online Courses

We offer pre-recorded and live online courses. Upon purchase, you will receive access to the course materials for the duration specified at the time of purchase. Course content may be updated or modified at our discretion.

4.2 Coaching and Private Sessions

We offer one-on-one coaching and private sessions. Scheduling, cancellation, and rescheduling policies are communicated at the time of booking. Missed sessions without adequate notice may be forfeited.

4.3 Membership Programs

We may offer subscription-based membership programs that provide ongoing access to content, community features, or other benefits. Membership terms, pricing, and renewal policies are described at the time of enrollment.

5. Payments and Billing

All purchases are processed through our third-party payment processor. By making a purchase, you agree to pay the applicable fees and any taxes. Prices are listed in U.S. dollars unless otherwise stated. Subscription fees are billed on a recurring basis according to the billing cycle you select. You authorize us to charge your payment method on file for recurring subscriptions until you cancel.

6. Refund Policy

We want you to be satisfied with your purchase. Our refund policy is as follows:

  • Online Courses: You may request a refund within 14 days of purchase if you have not completed more than 25% of the course content.
  • Coaching/Private Sessions: Cancellations made at least 48 hours before a scheduled session are eligible for a full refund or rescheduling. Cancellations made less than 48 hours in advance are not eligible for a refund.
  • Memberships: You may cancel your membership at any time. Cancellation will take effect at the end of your current billing period. No partial refunds are issued for unused portions of a billing period.

7. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, audio, video, course materials, and software, is the property of MasterClass with Melody or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, display, perform, or create derivative works from any content on the Site without our prior written consent.

8. License to Use Content

Upon purchasing a course or subscribing to a membership, we grant you a limited, non-exclusive, non-transferable, revocable license to access and view the purchased content for your personal, non-commercial use only. This license does not include the right to download (unless expressly permitted), share, resell, or redistribute any content.

9. User Conduct

You agree not to:

  • Use the Services for any unlawful purpose or in violation of these Terms
  • Share your account credentials with others or allow unauthorized access to your account
  • Copy, record, download, distribute, or share any course content or materials without written permission
  • Disrupt or interfere with the security or operation of the Site or Services
  • Harass, threaten, or abuse other users, instructors, or staff
  • Upload or transmit viruses, malware, or any harmful code
  • Use automated tools (bots, scrapers, etc.) to access the Site or Services

10. Termination

We reserve the right to suspend or terminate your account and access to the Services at our sole discretion, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Services will immediately cease. Any provisions of these Terms that by their nature should survive termination will remain in effect.

11. Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. We make no guarantees regarding the results you may achieve from using our courses, coaching, or other Services. Your results depend on your individual effort, background, and other factors.

12. Limitation of Liability

To the maximum extent permitted by law, MasterClass with Melody and its owners, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the Services shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless MasterClass with Melody, its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State in which our business is registered, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the “Effective Date” at the top of this page. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
